Privacy Policy

1. Introduction
Protecting personal data and guaranteeing the confidentiality and secrecy of the personal information of Clients and Authorized Users, and especially that of the Clients' patients in the Application, is a priority for HCMEDIC. For this reason, we faithfully comply with the requirements established by current legislation on personal data protection, and we urge Clients and Authorized Users of the Application to comply with the duties of secrecy and personal data protection established by the laws governing the Practice of Medicine, Personal Data Protection, and Patient Rights, among others.
2. Data Processing
As a normal part of the Application's activity, we collect and store the personal data of Clients and Authorized Users who complete the forms required to register in the Application. All requested data must be provided, so that all Client and Authorized User profiles are complete.
3. Consent for the Use of Personal Information
Clients and Authorized Users accept, consent and agree that we may process their personal data to fulfill the Application's functionalities, adapt the Application to their preferences and tastes, for consultation purposes, our own and third-party advertising, market research and/or for better configuration, management and administration of the Application.
By providing their email address, phone number and/or personal data, Clients and Authorized Users grant their prior, informed, express and unequivocal consent to receive communications with news, advertising and/or commercial promotions from HCMedic, as well as the products or services it markets or promotes.
To stop receiving communications with news, advertising and/or commercial promotions from HCMedic, Clients or Authorized Users may state so expressly or cancel their subscription to HCMedic's email services.
Clients expressly accept and consent to the transfer of their personal data to other Clients who request it in order to make contact and interact through the Application and/or to third-party companies interested in sending them offers regarding their products and/or services. Likewise, Clients expressly accept and consent to the transfer of their personal data to other Clients who are interested in and/or need to access the information of a common patient, whether that patient is currently or has previously been under treatment by one and/or both Clients. Likewise, Clients accept that the Application may use their patients' epidemiological data for statistical or scientific purposes, without this implying, in any way, the identification of such patients.
It is expressly noted that whenever patient data is used for such purposes, the information will be previously de-identified, in such a way as to prevent the patient's identity from being determined, directly or indirectly, through such information.
4. Destruction of Information
Once the relationship between HCMEDIC and a Client ends, for whatever reason, and after notifying the Client so they may download from the Application the information contained in their Virtual Practice and their patients' clinical records, we will make a backup copy of such information available to the Client so they can retrieve it from our offices within a maximum period of 180 days, after which we will proceed with its destruction.
Subsequently, we will delete all of their Personal Information and the data belonging to their patients that is included in the File and in the Patient Registry, except in cases where future data processing is anticipated, in which case HCMEDIC may retain such information for a maximum period of 2 (two) years.
In certain cases, we will keep in our files Personal Information of our Clients, Authorized Users and/or patients that we have been asked to remove, for the purpose of resolving disputes or claims, detecting problems or incidents and solving them, and complying with the provisions of the Application's Terms and Conditions and/or this Privacy Policy, for a period of time determined by law.
In any case, our Clients' Personal Information will not be immediately removed from our files for legal, accounting, tax and technical reasons, including security backup systems. Therefore, it should not be expected that all Personal Information of a Client, Authorized User and/or patient will be permanently deleted from our databases.
5. Order of Competent Authorities – Legal Requirements
We inform Clients and their Authorized Users that we may disclose the Personal Information they have provided us when registering and/or using the Application when required to do so by competent judicial or governmental authorities for the purposes of investigations conducted by them, even if there is no executive or judicial order or subpoena, or for example (and without limitation to this case) when it involves criminal or fraud investigations or those related to computer piracy or copyright infringement.
In such situations, we will cooperate with the competent authorities in order to safeguard the integrity and safety of individuals.
